CANCELLATION & REFUND POLICY
(FOR OUTSIDE INDIA CUSTOMERS)
We, Inwizards Software Technology (“We”, “Us”, “Our”, “Company”), provide a cloud-based point of sale software
application under the brand name “Online eMenu” for restaurants, along with optionally integrated
services such as mobile or card payments, inventory management, deals and discounts, ordering and delivery apps,
table booking apps, suppliers’ marketplace, analytics apps, and more, using a programmable API architecture.
The Company owns and operates the Online eMenu Platforms and licenses their use by way of various subscription
models for a Subscription Fee. This Cancellation & Refund Policy governs the cancellation and refund of such
subscriptions by users located outside India.
1. Subscription & Fees
- You are required to pay the subscription fee as per the Online eMenu Subscription plan
subscribed by you (“Subscription Fee”).
- The Subscription Fee is non-refundable except as expressly set forth in this Cancellation
& Refund Policy.
- Applicable taxes may be charged in addition to the Subscription Fee.
- Your paid Online eMenu Subscription will be activated only upon successful payment.
2. Subscription Cancellation & Refunds
- Cancellation within 15 Business Days: If you cancel your subscription within 15
business days of signing up, we will issue a full refund of the Subscription Fee, provided that we may
deduct the value of any Online eMenu benefits already used during this period.
- Annual Subscription (after 15 days): If you cancel an annual plan after 15 business
days, we will issue a pro-rata refund based on the unused portion of your subscription.
- Monthly Subscription: If you cancel a monthly plan, the Subscription Fee will be
refunded only if you have not used any Online eMenu services or benefits during that month.
- Refund Processing Timeline: Once approved, refunds will be processed within 7–10
business days and credited to your original method of payment (or by credit note, where applicable).
Please note that actual credit to your account may depend on your card issuer or payment provider’s
policies.
3. Termination by Us
- We may terminate your Online eMenu Subscription at our discretion, including for violation of
Terms of Service, applicable law, fraud, misuse, or conduct harmful to our interests or other users.
- If terminated by us for reasons other than fraud/misuse/legal violation, we will issue a
pro-rata refund for the unused portion of your subscription.
- No refund will be provided if termination is due to fraud, misuse, or violation of applicable
law.
4. Changes to Policy
We may update or revise this Cancellation & Refund Policy at our discretion. Changes will become effective
once posted on our website. Your continued subscription after such changes constitutes your acceptance. If you
do not agree, you must cancel your subscription.
5. Limitation of Liability
In addition to other limitations and exclusions in our Terms of Service, in no event will we or our directors,
officers, employees, agents, or representatives be liable for any direct, indirect, incidental, consequential,
special, or punitive damages arising out of or related to the Online eMenu Platforms or your subscription.
Our total liability, whether in contract, warranty, tort (including negligence), or otherwise, will not exceed
the last Subscription Fee paid by you. These limitations will apply to the maximum extent permitted by law and
will survive the cancellation or termination of your subscription.
